Job Description and Duties

Under the general direction of the Assistant Secretary, Office of Legal Affairs (OLA), the Chief Deputy General Counsel (CDGC), Career Executive Assignment (CEA) Level C is responsible for supervising and managing the Employment Advocacy and Prosecution Team (EAPT).  The EAPT operates under the Vertical Advocacy Model associated with employee disciplinary matters and issues relating to the Department’s internal affairs investigations.  The CDGC works closely with the Office of Internal Affairs, Office of the Attorney General, Office of the Inspector General, executive staff and hiring authorities to ensure employee discipline is delivered as mandated.  The CDGC plans, organizes, directs, coordinates, reviews and monitors EAPT’s legal caseload; develops and recommends policy impacting the operations of OLA; exercises independent judgment to resolve complex issues with statewide impact; and may act in the absence of the General Counsel.  The CDGC directly supervises EAPT’s Assistant Chief Deputy General Counsels and is the second-level supervisor for EAPT’s Assistant Chief Counsels.

Working Conditions

The EAPT office offers free on-site parking and is located off Highway 50 in close proximity to nearby shopping centers and restaurants.

This position is eligible for hybrid telework, in accordance with the Statewide Telework Policy and will be required to report to the office a m inimum of two days per week and as needed/required. Specific telework schedules may be discussed further during the interview process. The successful candidate must reside in California upon appointment.

Travel
On occasion, travel is required to EAPT offices located in Bakersfield and Rancho Cucamonga as well as to CDCR institutions or locations throughout the state for site inspections or interviews, State Personnel Board appearances, and court appearances.

Travel is compensated in accordance with the State Administrative Manual and CDCR travel policies.

Desirable Qualifications

In addition to evaluating each candidate's relative ability, as demonstrated by quality and breadth of experience, the following factors will provide the basis for competitively evaluating each candidate:

  1. Demonstrated ability to lead, plan, organize and direct the work of staff of a legal program.
  2. Experience which demonstrates the ability to communicate effectively, both orally and in writing, with client representatives, stakeholders, fellow leadership, courts or tribunals, and members of oversight agencies.
  3. Experience in the management of a public sector legal office handling high volume cases or investigations, demonstrated by a command of the principles and practices of public administration including program planning and evaluation;  policy development ; and personnel management, supervision, and discipline.
  4. Experience in the area of administrative hearings, trials, or other judicial proceedings, with an emphasis on the preparation, execution, and post-hearing proceedings, including investigative techniques, witness preparation, dispositive motions, settlement negotiations, evidentiary rules, direct and cross-examination of witnesses, use of expert testimony, persuasive argument, and application of legal standards.
